It is being delivered as a Progressive Design-Build with Target Price and the project is currently initiating the Development Phase to finalize the design and target price with the Contractor.Project planning is currently underway with opening of the new tunnel anticipated for 2030. To learn more about this exciting project please visit out project website at highway99tunnel.ca.Join Our Team!We are looking for a Commercial & Contracts (C&C) Director to lead the commercial management function of the $4.15 billion Fraser River Tunnel Project (the Project), which is being delivered as a Progressive Design-Build with Target Price. The Project is currently initiating the Development Phase to finalize the design and target price with the Design-Builder.The C&C Director is responsible for the development, day-to-day oversight and administration of commercial terms for contracts and agreements, such as the Design Early Works Agreement, Design-Build Agreement and municipal and third party agreements. The C&C Director provides direction and leadership to a team of commercial and contracts staff assigned to the Project, and supports capacity building initiatives of TICorp’s C&C team.The C&C Director will be accountable for providing strategic professional judgement on commercial matters related to the Project under the following core areas:ProcurementTarget Price DevelopmentChange ManagementPayment and Performance Incentive ManagementClaims ManagementDisputes ManagementDrafting Contractual CorrespondenceWhy Join Us?Impactful Work - play a crucial role in in ensuring the successful completion of a high-profile project that will shape the community and the future.Professional Growth - leverage your extensive experience and expertise to drive innovation and excellence in construction practices and project management.Collaborative Environment - work within a dynamic team committed to excellence and innovation.Competitive Compensation - receive a comprehensive benefits package and competitive salary.What we offer?Vacation starts at five weeks and with an additional one day per year of service to a maximum of six weeks.TI Corp is dedicated to professionally growing staff and building internal capacity, through mentorship, active succession planning, learning and development financial assistance, and membership dues.Extended health and dental benefits plus a $1000 Health Spending Account annually.We are part of the BC Public Sector Pension Plan – if you join us from other Public Service or Public Sector organizations who are part of this pension plan, your pension will continue seamlessly.Hybrid work arrangement with the ability to work from home two days a week following an orientation period.Top-up allowance for maternity and parental leave.Free travel insurance for full-time employees.Key Accountabilities:Manages the team responsible for administering the commercial terms of the Design Early Works Agreement (DEWA) and Design-Build Agreement between the owner and Design-Builder, working closely with the TICorp’s technical, construction, legal and other discipline-specific teams.Maintains an extensive knowledge of commercial implications within Project-related agreements and provide subject matter expertise to the team as required.Supports development of a constructive and transparent relationship with contractors.Leads owner’s collaborative development of the Design-Builder’s target price.Leads negotiations relating to change and claims management, demonstration of entitlement, and resolution of disputes.Manages the communications relating to commercial matters, including assessment, development of options, and drafting of contractual correspondence.Coordinates with the Technical Program Director on review and responses to contractor’s schedule submissions and progress monitoring.Leads the progress payment and certification processes.Oversees the management of the performance mechanism from a commercial lens.Coordinates with Project risk team to identify project risks and develop strategies to manage and/or mitigate.Leads and contributes to the Commercial & Contracts corporate community of practice building capability within TI Corp by sharing skills, knowledge and experience.Implements a Commercial Management Plan to ensure the Province’s obligation under contracts are fulfilled leading updates as required.Qualifications:Bachelor’s degree in law, civil engineering, quantity surveying or construction management, or equivalent relevant experience.At least 15 years of experience in commercial & contract management roles, primarily on major civil infrastructure projects in either an Owner’s team interacting with the prime contractor and/or a design-builder’s team, demonstrating a progressive increase in accountabilities, with a minimum of 5 years at a senior level.Experience leading the commercial management of major civil infrastructure construction projects, including payment, performance incentives, claims management, dispute resolution and contract correspondence.Preference will be given to candidates with experience in some or all of the following areas:Directing cost estimating and scheduling resources for heavy civil type works.Open-book cost estimation processes leading to agreement of contract price.Development and commercial management of a Target Price.Commercial delivery of Design-Build projects, including Progressive Design-Build / two stage bid models.Note:You must be legally authorized to work in Canada.Collection Notice: Your personal information is collected from LinkedIn by Transportation Investment Corporation (TI Corp) pursuant to 26(c), 26(e), and 27(1)(a)(i) of the Freedom of Information and Protection of Privacy Act for the purpose of TI Corp recruitment.
